§ 30.04 LEGAL COUNSEL.
   (A)   There is hereby created the office of Legal Counsel to the Board of Trustees of the village.
   (B)   The Legal Counsel to the Board of Trustees shall be appointed upon motion made by the President of the Board of Trustees or any Trustee of the village, and, upon a simple majority of the votes cast by the members of the Board of Trustees in favor of that motion.
   (C)   The term of office for the Legal Counsel to the Board of Trustees shall be for one year and shall begin on the first Tuesday of each May.
   (D)   Should a vacancy in the office of Legal Counsel to the Board of Trustees occur, either by the expiration of the term of Legal Counsel or resignation of the Legal Counsel, the tenured Legal Counsel shall continue in office until his or her successor is qualified by the Board of Trustees.
   (E)   It shall be the duty of the Legal Counsel to the Board of Trustees to:
      (1)   To prosecute or defend all suits or causes of actions to which the village, or its Board of Trustees, may be a party, or which it may have an interest in, or which may be brought against by an officer of the village on behalf of the village or in the capacity of such person as an officer of the village.
      (2)   See to the full enforcement of all judgments or decrees entered in favor of the village and all similar interlocutory decrees.
      (3)   Be the legal adviser to the Board of Trustees and render advice to the Board of Trustees on all legal questions effecting it when requested to do so by a member of the Board of Trustees, including its President, and upon request to reduce any such opinion in writing.
      (4)   Prosecute to completion all special assessment proceedings and condemnation proceedings.
      (5)   Supervise the drafting of any contract, lease or other legal document or instrument to which the Board of Trustees may be a party.
      (6)   Draft all ordinances or resolutions as requested covering any subject within the powers of the municipality.
      (7)   Retain special counsel to advise or represent the Board of Trustees, the village, or any of its officers on special matters or to assist the Legal Counsel to the Board of Trustees in any matter.
