§ 94.05 PROCEDURE FOR APPEALS.
   Whenever the Fire Marshal, or designee of the Fire Department disapproves an application or refuses to grant or permit applied for under the local ordinances or NC Fire Code adopted by this subchapter, or when it is claimed that the provisions of this chapter do not apply or that the true intent and meaning of this chapter have been misconstrued or wrongly interpreted, the applicant may appeal from the decision to:
   (A)   The Fire Chief. Appeals must be presented in writing within three days of notice of the violation.
   (B)   If the violator is not satisfied with the decision of the Fire Chief they may appeal in writing and within ten days of the decision. The decision of the Town Manager shall be final.
   (C)   Appeals involving the NC Fire Code may be directed to the state following the North Carolina appeals process set forth in the NC Administrative Code.
