§ 95.041 DEAD OR DISEASED TREE REMOVAL ON PRIVATE PROPERTY.
   (A)   The town shall have the right to cause the removal of any dead or diseased trees on private property within the town, when the trees constitute a hazard to life and property, or harbor insects or diseases that constitute a potential threat to other trees in the town.
      (1)   The town will notify the owners of the trees in writing.
      (2)   Within 60 days after the date of service of notice and at their own expense, the owners shall do removal.
   (B)   In the event of failure of owners to comply with the provisions, the town shall have the authority to remove the trees, and to charge the cost of removal to the owner.
