7-3-20: GROWING MEDICAL MARIJUANA:
The growing of medical marijuana for personal use by a registry identification cardholder shall comply with the following regulations in all structures in all districts in the Town:
   A.   No more than six (6) marijuana plants, with three (3) or fewer being mature, flowering plants that are producing a usable form of marijuana, may be grown in any dwelling unit or accessory building to a dwelling unit for each registry identification cardholder residing in that dwelling unit. No more than twelve (12) total marijuana plants, with six (6) or fewer being mature, flowering plants that are producing a usable form of marijuana, shall be grown in any dwelling unit or accessory building to a dwelling unit.
No more than twelve (12) marijuana plants, with six (6) or fewer being mature, flowering plants that are producing a usable form of marijuana, may be grown in any building other than a dwelling unit or accessory building to a dwelling unit.
   B.   Growing and storage of medical marijuana shall occur only within a completely enclosed structure that complies with all applicable Building and Electrical Codes.
   C.   Growing and storage of medical marijuana shall not occur in a common area associated with a dwelling unit.
   D.   Growing shall be for personal use only by a registry identification cardholder residing in the dwelling unit. The retail or wholesale sale of goods or products derived from the growing of medical marijuana is prohibited, and any off site distribution of such plants or derived products is also prohibited.
   E.   This regulation shall not be construed to preclude primary caregivers as the same are defined in article XVIII, section 14(1)(f) of the Colorado Constitution and Colorado Revised Statutes section 25-1.5-106(2) from providing services as defined and limited in Colorado Revised Statutes section 25-1.5-106.
   F.   It is unlawful for any person to operate, cause to be operated, or permit to be operated a medical marijuana center, optional premises cultivation operation, or facility for which a medical marijuana infused products manufacturers' license could otherwise be obtained within the Town, and all such uses are hereby prohibited in any location within the Town, or within any area hereinafter annexed to the Town as further described in title 3, chapter 6 of this Code.
