§ 51.26 APPLICATION FOR WATER.
   (A)   Persons desiring a supply of water shall file a written application with the Administrator-Clerk-Treasurer upon blanks furnished for this purpose or use.
   (B)   It shall be the duty of the Administrator-Clerk-Treasurer to notify the City Council of new construction or water line extensions and the City Council shall examine or disallow the same; if allowed, the Administrator-Clerk-Treasurer shall furnish the applicant with a permit duly executed, allowing the request contained in the application and all the rules, regulations and rates herein set forth are to be considered a part of the contract with the said applicant.
   (C)   All applications for water must be made by the owner of the property to be served or his or her duly authorized agent. Where more than one tenant, tenement or premises is supplied through one service pipe, the application shall be made by the owner thereof, who shall be responsible for all water supplied through the service pipe or pipes. However, every water meter taking water on that premises must pay the base fee, the minimum water usage fee, the per thousand gallons usage over the minimum water allowed, plus any additional base fees determined on the number of tenants taking water on the premises, except as follows:
      (1)   Nursing homes and assisted living units shall pay one base fee and will be billed for actual gallons used, one minimum water usage fee and water usage over the minimum allowed, for the main part of their nursing facility. All assisted living units shall be charged one base fee per unit. Each apartment unit attached to a nursing home facility shall pay the base fee, the minimum water usage fee and water usage over the minimum allowed per unit;
      (2)   Apartment complexes of 21 units or more located in one building with one service pipe shall pay one base fee and will be billed for actual gallons used, one minimum base fee for each apartment unit within that building and that base fee per unit will include an allowance of the minimum gallons of water per month, per unit.
