§ 51.067  INDUSTRIAL WASTE STRUCTURES REQUIRED.
   (A)   In order to equalize flows over a 24-hour period, each person discharging a waste into the town’s sanitary sewers having a volume in excess of 40,000 gallons in any one day shall construct and maintain at his or her own expense a suitable storage tank. The tank shall have a capacity of at least 80% of the normal volume of one 24-hour production period of waste and whose outlet to the sewer is controlled by a water works-type rate controller, or other approved devices, the setting of which shall be directed by the Approving Authority.
   (B)   Any person discharging any amount of industrial wastes into town sanitary sewer shall construct and maintain a suitable control manhole, downstream from any treatment, storage or other approved works, to facilitate observation, measurements and sampling of all industrial wastes from the industry. The control manhole shall be constructed at a suitable and satisfactory location and built in a manner approved by the Approving Authority. Where a storage tank is not required, the control manhole shall be equipped with a permanent type volume measuring device such as a nozzle, or other suitable devices as may be approved by the Approving Authority. The manhole shall be installed by the person discharging the wastes at his or her expense and shall be maintained by him or her so as to be safe, accessible and in proper condition at all times.
   (C)   Control manhole requirements may be waived by the approving authority when a person discharges less than 40,000 gallons of industrial wastes on a normal working day, providing:
      (1)   That such wastes meet all other requirements of this subchapter as determined by the Approving Authority;
      (2)   That such person was operating at his or her present location before the adoption of this subchapter (effective date, January 30, 1973);
      (3)   That all such wastes are discharged through a single standard sewer manhole before entrance into the town’s sanitary sewer; and
      (4)   That said person agrees to pay a surcharge double that required under state statutes and that the strength of the waste on which the surcharge is made will be based on tests made on similar wastes discharged by other industries of the same type, if such information is available; if not, by such other methods as the Approving Authority may wish to employ. Whatever method is used for finding the strength of the waste, the determination of the Approving Authority shall be binding as a basis for surcharges.
   (D)   Plans for the construction of said storage tank, control manhole and controlling devices shall be approved by the Approving Authority prior to the beginning of construction.
