(A) The Board of Commissioners may in its discretion, as a condition under which water or sewer service or both will be extended, require the owner or owners of a proposed subdivision to enter into an agreement to improve the proposed streets, sidewalk, curb and gutter therein at their own expense and in accordance with any applicable provisions of this code or other ordinances of the town then in force governing the acceptance of public streets for the town.
(B) This section will apply to subdivisions which are located either within or outside the corporate limits of the town.
