§ 151.13  LIMITATION ON ORDERS AND ORDINANCES.
   (A)   Historic landmark or district. Notwithstanding any other provision of this chapter, if the nonresidential structure is designated as a local landmark, listed in the National Register of Historic Places or is designated a historical property by the Board of Commissioners of the town and the Board determines, after a public hearing, that the structure is of individual significance or contributes to maintaining the character of the district, and the structure has not been condemned as unsafe, the order of the Enforcement Officer issued pursuant to § 151.10 may only require that the structure be vacated and closed until it is brought into compliance with the minimum requirements established in this chapter by removing the conditions set forth in § 151.06.
   (B)   Vacant manufacturing facility or vacant industrial warehouse. Notwithstanding any other provision of this chapter, the order of the Enforcement Officer issued pursuant to § 151.10 may not require repairs, alteration or improvement to be made to vacant manufacturing facilities or vacant industrial warehouse facilities to preserve the original use. The order may require such structure to be vacated and closed, but repairs may be required only when necessary to maintain structural integrity or to abate a health or safety hazard that cannot be remedied by ordering the structure closed for any use.
