§ 72.55  ENFORCEMENT OF TRAFFIC AND PARKING REGULATIONS.
   (A)   Any person failing or refusing to comply with the directions indicated on any sign, marker, curbing or device for control or regulation of parking or traffic flow, erected or placed in accordance with the provisions of this chapter, when so placed, designated or erected, shall be guilty of an infraction.  This section shall not be construed to apply when the driver of a vehicle is otherwise directed by a police officer or when an exception is granted to the driver of an authorized emergency vehicle as from time to time defined by the laws of the state, as defined in G.S. § 20-156, as amended.
   (B)   If any vehicle shall be found illegally parked or parked overtime, it shall be the duty of the Chief of Police or other peace officers of the town to attach to the vehicle a notice to the owner or operator thereof, if the owner or operator is absent, or to deliver to the owner or operator, if he or she is present, a notice to the effect that the vehicle has been illegally parked or parked overtime as the case may be.  Such notice shall state the amount of the fine for such illegally parked vehicle, as well as the date, time and location of the vehicle at the time the notice is placed, left or delivered.  The notice shall also state the vehicle license plate number and shall contain the issuing officer’s signature.
   (C)   The person actually operating or in control of the operation of the vehicle at the time that such vehicle is parked shall be charged with the duty of complying with the provisions of this section, provided that the proof of ownership of any vehicle found parked in violation of this section shall be prima facie evidence that the owner was then operating and parking such vehicle.
   (D)   This section shall be deemed not to be in conflict with the provisions of § 72.37 that deal with the concern of emergencies and the blocking of driveways.
   (E)   For purposes of enforcement of this section, security guards, officials and police officers employed by Wingate College shall have authority to issue notice for the purposes of and in accordance with the provisions of this section.
   (F)   The provisions of this section shall apply to all streets, roads, highways and other locations and areas within the town designated now, and from time to time in the future, as parking or no-parking zones and areas by the town or by any other governmental unit or agency thereof with the town’s approval.
   (G)   All areas and locations where parking is limited or prohibited or regulated shall be shown on a map or maps as from time to time amended by the Board of Commissioners and maintained in the Town Hall.
   (H)   Certain intersections marked as no-parking and tow-away zones, as well as other areas marked and designated as tow-away zones, including areas within the immediate vicinity of a water hydrant or plug shall be enforced in accordance with the procedure set forth in § 72.37, except that any police officer of the town has the authority to initiate and complete such tow-away without request of another person, and it shall be such officer’s duty to do so.
