§ 71.039 RESTRICTED STREETS; TRUCK USE RESTRICTED.
   (A)   From and after the taking effect of this chapter, all streets and alleys of the town except those set out in Chapter 75, Schedule II shall be designated as restricted streets, and it shall be unlawful for the driver of any truck, excepting trucks in the following three categories, to drive upon same except for the purpose of making a delivery to the business in the block in which the vehicle is being driven:
      (1)   Those of less than five-tons' rated capacity;
      (2)   House moving vans; and
      (3)   Construction vehicles.
   (B)   Any driver making a delivery on a restricted street shall enter same at the first intersection nearest the point of delivery and leave same at the first intersection after the delivery.
   (C)   Penalty. Any person who violates this section and chapter shall be subject to the following penalty and fine schedule:
      (1)   The penalty for an initial violation of this section shall be in the amount of $250 for the first violation; thereafter, the penalty shall be $500 for a second and each subsequent violation occurring within a consecutive 12 month period.
      (2)   Each occurrence shall constitute a separate violation.
