§ 156.152 HOME OCCUPATIONS.
   A home occupation which is accessory to the residential use of the property shall be permitted subject to the following conditions.
   (A)   No home occupation shall be operated in manner that creates excessive noise, odor, or other nuisances, creates traffic, fire, or any other safety hazard, or is operated in violation of any and all applicable federal, state, and local laws, rules, and regulations.
   (B)   No walk-in retail sales shall be conducted on premise.
   (C)   There shall be no bulk storage of stock or materials.
   (D)   A home occupation may only employ resident family members and one non-resident person.
   (E)   The gross floor area for home occupation use shall be less than 20% of gross floor area of the structure, but in no event shall gross floor area for home occupation use exceed 500 square feet.
   (F)   All parking shall be off-street.
   (G)   All business shall be conducted by appointment only.
   (H)   No home occupation shall use signs, lighting, or any other visible display to indicate the presence of a business in the dwelling unit.
   (I)   If the home occupation is a child day care facility, the administration of this chapter shall be in compliance with I.C. 36-7-4-1108. A child care home will be responsible for meeting the zoning requirements, developmental standards, and building codes as applicable.
   (J)   All activities of the home occupation, including storage, shall be conducted within the dwelling or accessory building.
   (K)   All pickups and delivery of materials used in the home occupation shall be carried out between 9:00 a.m. and 8:00 p.m.
   (L)   The Building Administrator may review any home occupation with the provisions of this chapter. In the event he or she determines a home occupation fails to comply with this chapter, the operator may request a review of that decision by the Board of Zoning Appeals.
   (M)   Should a majority (50% +1) of the adjacent residents file written complaints regarding the conduct of the home occupation, the Building Administrator shall investigate the complaints and forward the complaint to the Board of Zoning Appeals for review and appropriate action up to and including ordering the home occupation to cease operations.
