§ 155.110 PURPOSE AND POLICY.
   (A)   This chapter, including guidelines and criteria, does not provide solutions to all drainage problems, nor is the Engineer restricted to these designs or procedures exclusively. Although the policies as stated will hold true for most development work in this area, the town realizes that there may be some exceptions to the policies or the criteria which, on individual projects, could involve special or unusual drainage design problems that should be reviewed prior to completing the drainage plans.
   (B)   The purpose of this subchapter is to diminish threats to public health, safety, and welfare caused by runoff of excessive stormwater from new development and redevelopment, and to reduce the pollutants in stormwater runoff. This excessive stormwater could result in the inundation of damageable properties, the erosion and destabilization of downstream channels, and the pollution of valuable stream and lake resources. The cause of increases in stormwater runoff quantity is the development and improvement of land, and thus this chapter regulates these activities to prevent adverse impacts.
   (C)   The policy of the town shall be:
      (1)   All information necessary will be submitted to the town to determine how the stormwater rate of runoff should be controlled within the development prior to the release of runoff to downstream properties for all proposed developments;
      (2)   All stormwater drainage facilities within a development shall be designed to have capacity for the total tributary area, at the design storm frequency;
      (3)   All proposed developments with a runoff rate greater than that for which downstream is or will be designed, will be required to control the rate of stormwater discharge so as not to adversely impact the downstream system; and
      (4)   Unless otherwise approved by the town, all developments will be required to control the discharge flow rate of stormwater to the rate specified in the town's Stormwater Quantity and Quality Management Ordinance. The town reserves the right to mandate stricter release rates from certain developments in sensitive areas, when it sees fit to do so and on the advice of its Engineer.
