§ 150.21 DEFINITIONS.
   (A)   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      BASEMENT. A portion of a building which is partially or entirely below grade, so that the distance between the floor and the average external grade is at least 51% of that of the floor to ceiling height. Any portion of a BASEMENT which is intended to be used, or specifically designed to be used, as living space will be charged the living space rate for purposes of calculating building permit fees in this subchapter.
      CONDOMINIUM. Property subject to I.C. 32-32-25.
      CONSTRUCTING. See OPENING.
      GARAGE. Structures designed to store motor vehicles and other personal property and not designed or intended to be used as living space.
      LIVING SPACE. All floor area of any building or portion thereof designed or modified to be used as permanent living facilities, including but not limited to provisions for sleeping, eating, cooking, recreation, entertainment, and sanitation. All hallways, closets, utility rooms, laundry rooms, and storage facilities constructed as an integral part of the living area are also considered LIVING SPACE. Garages and basements as defined in this section and any integral storage spaces thereof are not considered LIVING SPACE.
      MULTI-FAMILY. Any single structure that contains more than two residential dwelling units.
      ONE- AND TWO-FAMILY DWELLING. Any housing structure permitted under the State of Indiana One- and Two-Family Dwelling Code (CABO), including townhomes.
      OPENING. Any opening made by an individual, company, agent or representative, of a town street, allay, sidewalk or any portion of the public way, including any turf areas or areas not covered by impervious surfacing.
      SWIMMING POOL. Any pool subject to the state Swimming Pool Code.
   (B)   Terms not specifically defined in this section have meanings defined in the town’s adopted building codes, or if not defined in those codes, their customary meaning as used in the construction trade.
