(A) Definition. As used in this section, COMPRESSION RELEASE ENGINE BRAKE means a hydraulically operated device that converts a power producing diesel engine into a power absorbing retarding mechanism.

(B) Prohibition. All motor vehicles are prohibited from using compression release engine brakes within the corporate boundaries of the town, except in the event of the failure of a vehicle’s service brake system.
(C) Penalty.
(1) Each violation of this section shall be punishable by a fine as follows:
First offense | $100; |
Second offense | $250; |
Third offense | $400; |
Fourth offense | $600; |
Each additional offense thereafter | $600. |
(2) However, no agent or employee acting under the direction, rules, or orders of the firm, company, or corporation shall be fined for violation(s) of this section.
