§ 159.09 CONSTRUCTION, PLACEMENT, AND USE OF SMALL CELL FACILITIES.
   (A)   An application for construction, placement, and use of small cell facilities must include all of the following:
      (1)   Name, address and contact information for applicant;
      (2)   Location of the affected wireless support structure(s); and
      (3)   Evidence showing that application complies with applicable building requirements.
      (4)   Evidence showing that the application complies with Federal Communications Commission requirements; and
      (5)   Evidence showing that application complies with industry standards.
   (B)   An applicant may submit a single consolidated application for multiple small cell facilities that are located within the permit authority's jurisdiction and constitute a single small cell network, and the town shall issue a single permit for all facilities included in the application rather than multiple permits for each facility.
   (C)   Within ten business days of receipt, the Building Administrator shall notify the applicant in writing of all defects in the application. If notice is not given within ten business days, the application is considered complete.
   (D)   The applicant may cure defects and resubmit the corrected application within 15 days of receiving the notice.
      (1)   The applicant shall notify the town within the 15-day period if additional time is required to cure the defects.
      (2)   Upon determination of a complete application, a notice shall be posted on the town website and applicant will be provided a list of interested parties that have registered with the town. Applicant will send a copy of the notice via First Class mail, at its expense, to all interested parties. Applicant shall provide proof of mailing to the town. An interested party is defined as: (a) a neighborhood association or homeowners association that is registered with the town; and (b) owners of record, as identified by the Lake County Auditor's Office, abutting the proposed location and lying on the opposite side of the right-of-way from the proposed location and abutting parcels.
   (E)   Not more than 60 days after determination of a complete application for small cell facilities, the Town Engineer or designee, with concurrence of the Building Administrator, shall review the application to determine if it complies with applicable building permit requirements, and notify the applicant in writing if application is approved or denied. If the applicant requested additional time to cure defects, the 60-ay period is extended for a corresponding amount of time.
   (F)   The town may propose an alternate location to collocate a small cell facility on an existing utility pole or wireless support structure within 50 feet of the proposed location of a new wireless support structure. The applicant shall use the alternate location if:
      (1)   The applicant's right to collocate is subject to reasonable terms and conditions; and
      (2)   The applicant determines the alternate location does not cause technical limitations or additional costs.
   (G)   The town may charge an annual fee for small cell facilities collocated on a utility pole owned or under its control, and may impose additional general terms and conditions for collocation which are reasonable and nondiscriminatory.
