§ 32.70 EMERGENCY MEDICAL SERVICES.
   (A)   For the use of emergency medical services rendered and provided by the Lakes of the Four Seasons Volunteer Fire Force, ("LOFSVFD"), included in the agreement between the town and LOFSVFD, the following fees and charges shall hereinafter be charged and collected from residents and non-residents of the town, as defined herein, benefitting and receiving the same, and shall be payable as hereinafter provided and in an amount determinable as follows:

Basic Life Support (BLS) - Transportation by ground ambulance vehicle and the provision of medically necessary supplies and services, including BLS ambulance services as defined by the state. The ambulance must be staffed by an individual who is qualified in accordance with applicable state and local laws as an emergency medical technician-basic (EMT-Basic).

Advanced Life Support, Level 1 (ALS1) - Transportation by ground ambulance vehicle and the provision of medically necessary supplies and services including the provision of an ALS assessment or at least one ALS intervention.

Advanced Life Support, Level 2 (ALS2) - Transportation by ground ambulance vehicle and the provisions of medically necessary supplies and services including: (1) at least three separate administration of one or more medications by intravenous push/bolus or by continuous infusion (excluding crystalloid fluids); or (2) ground ambulance transport, medically necessary supplies and services, and the provisions of at least one of the ALS2 procedures listed below:
a.   Manual defibrillation/cardioversion;
b.   Endotracheal intubation;
c.   Central venous line;
d.   Cardiac pacing;
e.   Chest decompression;
f.   Surgical airway; or
g.   Intraosseous line.

*Non-Resident is defined as a person who lives outside of the corporate boundaries of any unit of local government under contract for the same or similar services provided by LOFSVFD to the town pursuant to agreement and as set forth in this subchapter now, and as amended hereafter, from time to time.
** Resident is defined as a person who lives within the town's municipal corporate boundaries, or within the boundaries of any unit of local government under contract or agreement with the LOFSVFD for provision of the same or substantially similar services.
   (B)   All billings not paid within 30 days of the billing shall accrue interest at the rate of 1% per month on the unpaid balance, which shall be known as a late fee. The date which the original bill was provided to the individual(s) receiving emergency services shall be known as the billing date. In the event that a balance remains unpaid after 90 days from the billing date, the amount may be referred for legal collection proceedings to begin. In the event that it is necessary to file a lawsuit to collect unpaid billings, authorization is hereby made to collect court costs and reasonable attorney fees, in addition to all other fees stated herein.
   (C)   The fees and charges established herein for the use of Emergency Medical Services rendered and provided by the Lakes of Four Seasons Fire Force shall be the fees and charges for the current year, and through December 31, 2022. Thereafter, for each calendar year, the fees and charges established herein shall increase by 3% for that calendar year. The LOFSVFD shall present its next annual year schedule of increased fees and charges on or before December 1 of the then-present year for the next succeeding year to the Town Council for revision and approval consideration. Upon approval, which shall be at the sole discretion of the Town Council, such presented increased schedule of fees and charges shall be effective as of January 1 of the next succeeding year, or at such other schedule increase date as the Town Council deems appropriate. The Town Clerk-Treasurer shall present the increased schedule of fees and charges authorized by the Town Council to be appended hereto. The Town Council retains the authority to discontinue, terminate, or stay the annual increase of fees and charges at any time it deems appropriate and in the best interests of the town.
