§ 93.04 REGULATION OF OUTDOOR EVENT/SPECIAL EVENT.
   (A)   Alcohol. Any person sponsoring or operating an outdoor event/special event, which dispenses and serves beer, wine and/or liquor, shall confirm that it has the proper permits for provision of the same, as may be required by the Indiana Alcohol and Tobacco Commission, and provide such documentation in form and content acceptable to the town. The area where alcohol is served shall be roped or blocked off, with only one entrance to such area, and which area must be posted with a “NO MINORS” sign. Responsibility for ascertaining age (21 and up) lies with the sponsor or operator of the event. Serving of any alcohol shall be governed by the rules and regulations of the State of Indiana. Alcohol regulation shall be subject to review and oversight by the Town Marshal, or an authorized representative the Town Marshal’s Office.
   (B)   Music. Any outdoor event/special event which has any type of outside music, shall end said music no later than 10:00 p.m., Sunday through Thursday, and no later than 12:00 a.m., Friday and Saturday. Noise regulation shall be subject to regulation by the Town Marshal, or an authorized representative from the Town Marshal’s Office.
   (C)   Security. All outdoor event(s)/special event(s) shall be required to provide security for said event at the sole discretion and determination by the Town Marshal, or an authorized representative from the Town Marshal’s Office. Security shall be provided at all outdoor event(s)/special event(s) where alcohol is being served.
   (D)   Insurance. Any person who is the sponsor or operator of an outdoor event/special event shall be required to provide proof of financial responsibility in the form of liability insurance to cover injury to person or property of not less than $1,000,000 in respect to cases of bodily injury or death to any one person, and not less than $1,000,000 for each incident of property damage. No permit shall be issued by the town unless and until proof of liability insurance is submitted with the permit application which includes the town as an additional insured under said liability insurance policy.
   (E)   Fire/electrical inspection. Any person who is the sponsor or operator of a outdoor event/special event shall be required to have an electrical and fire inspection by the town prior to the commencement of an event which requires the use of electricity.
   (F)   Parking. Specified parking areas shall be established in cooperation with the Town Marshal’s Office and Town Street Department, to accommodate any outdoor event/special event. Residential streets shall not be used for parking for an outdoor event/special event, unless permitted by the Town Marshal’s Office and Town Street Department. Any sponsor or operator of an outdoor event/special event, who is seeking a permit from the town under this chapter, shall be required to provide a parking plan/schedule for review by the town at the time the permit application is submitted and filed with the town.
   (G)   Penalties for non-compliance. Any person operating or sponsoring an outdoor event/special event, who violates any of the provisions of this chapter, may be liable for a fine up to $250 for the first violation; $500 for the second violation; and $1,000, for each subsequent violation of this chapter during a calendar year. Each day a violation occurs shall constitute a separate violation. The Town Marshal, or an authorized representative from the Town Marshal’s Office, shall have the authority to immediately close and terminate any outdoor event/special event for violation of any provisions of this chapter, and to rescind the permit issued by the town under this chapter.
