(A) There is hereby established a fund to be known as the town "Local Law Enforcement Continuing Education Fund" (LECEF) for the purpose of providing continuing legal education, and law enforcement training for law enforcement officers of the town.
(B) The town LECEF shall be funded by fees collected by the Office of the Town Marshal, as identified in I.C. 5-2-8-2, as amended from time to time, which include the following activities:
(1) Vehicle identification number inspections;
(2) Preparation of accident reports;
(3) Costs and fees collected by the town for deferral/pretrial diversion programs; and
(4) Handgun application licensing.
(C) Before any of the funds under this section are spent, the same must be first appropriated as required under applicable law, as amended from time to time.
(D) The funds accumulated in the town LECEF shall be used for the purpose of continuing education and training of law enforcement officers of the town. All expenditures must comply with the terms and provisions of I.C. 5-2-8-2, as amended from time to time, and must be approved by the Town Marshal.
(E) The funds deposited into the town LECEF may not be withdrawn except for the purpose(s) set forth herein, so long as this section remains in full force and effect.
