§ 92.03 NUISANCE DOGS.
   (A)   A dog shall be regarded as a statutory nuisance if it is:
      (1)   Not licensed pursuant to the provisions of § 92.02 and shall be regarded as a nuisance pursuant to I.C. 15-5-9-14; or
      (2)   Not immunized pursuant to I.C. 35-46-3-1; or
      (3)   Has violated any other provision of this chapter and other applicable laws contained in the Indiana Code and the Indiana Administrative Code.
   (B)   A dog shall be regarded as a general nuisance if it exhibits any of the following traits and or has committed acts such as:
      (1)   Habitual or repeated destruction of any public or private property;
      (2)   Desecration or soiling of any public or private property;
      (3)   Habitual chasing of persons; and
      (4)   Running-at-large causing a disturbance to the peace or causing injury to threat of injury to persons or property
   (C)   It shall be the duty of the dog's licensed owner to correct violations of this section and to pay the applicable penalties assessed and developed by the town pursuant to § 92.99.
