§ 90.02 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   AUTHORIZED INDIVIDUAL. A person who is a designee of the Town of Winfield.
   DANGEROUS TREE/STACK. Any tree, stack, or other object standing in a condition so that may, if the condition is allowed to continue, endanger the life, limb, or property of, or cause hurt, damage, or injury to persons or property of residents, public streets, or public ways adjacent thereto, by the falling thereof or of parts thereof.
   GARBAGE. Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking, and consumption of food.
   LITTER. Garbage, refuse and rubbish as defined herein and all other waste material which, if thrown or deposited as herein prohibited, tends to create a danger to public health, safety and welfare.
   NOXIOUS WEEDS AND RANK VEGETABLES.
      (1)   Vegetation on private or governmental property which is abandoned, neglected, disregarded or not cut, mown, or otherwise removed and which has attained a height of 12 inches or more, with the same constituting a nuisance;
      (2)   Vegetation, trees or woody growth on private property which, due to its proximity to adjacent property, right-of-way or easement, interferes with the public safety or lawful use of the adjacent property, right-of-way or easement or which has been allowed to become a health or safety hazard; with the same constituting a nuisance.
   NUISANCE. The undertaking of an unlawful act, omission, or failing to perform a duty, or causing suffering or permitting any condition or thing to be or exist, which such act, omission, condition, or thing either:
      (1)   Injures or endangers the comfort, repose, health, or safety of others;
      (2)   Is offensive to the senses;
      (3)   Unlawfully interferes with, obstructs or tends to obstruct, or renders dangerous for passage any public or private street, highway, sidewalk, stream, easement, ditch, or drainage;
      (4)   In any way renders other persons insecure in life or the use of property;
      (5)   Essentially interferes with the comfortable enjoyment of life and property, or tends to depreciate the value of the property of others; or
      (6)   Violates the different ordinances of the town, or provisions of this code, the Indiana Code, the Indiana Administrative Code, and any applicable federal law, as amended from time to time.
   OCCUPANT. A person, firm, partnership, association, corporation, business trust, joint stock company, unincorporated organization, religious or charitable organization, or entity who is, from time to time, in possession or exercising dominion and control over the real estate or any house or other structure located thereon. Occupant shall include any lessee of the property.
   OWNER. The record owner or owners as reflected as reflected by the most current records in the township’s assessor’s office of the township in which the real estate is located.
   PERSON. Includes a natural person, joint venture, joint stock company, partnership, association, club, company, corporation, business, trust organization, or the manager, lessee, agent, servant, officer or employee of any of them.
   PRIVATE PROPERTY. All real estate within the Town of Winfield, except property owned by a governmental unit.
   RECIPIENT. The owner or occupant to whom a notice of a violation of this subchapter has been directed.
   REFUSE. All putrescible and nonputrescible solid wastes (except body wastes), including garbage rubbish, ashes, street cleanings, dead animals, abandoned automobiles, and solid market and industrial waste.
   RUBBISH. Nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, tin cans, yard clippings, leaves, wood, glass, bedding, or similar materials.
