Any person who shall take advantage of the handicapped parking permit granted under this section when the vehicle is not being used to transport a physically handicapped person, or otherwise parks his or her vehicle in a parking spot designated for use by a physically handicapped person without visibly displaying a handicapped parking permit, shall be subject to a fine of $100 for the first violation, and thereafter, a fine of $150, but not more than $250 for each subsequent violation occurring within a consecutive 12 month period.
