§ 155.038 PROCEDURE.
   (A)   At the time of primary approval of the subdivision, the Plan Commission may recommend land to be dedicated. The recommendation by the Plan Commission shall include the following:
      (1)   The amount of land required;
      (2)   That a stated amount of credit be given for private recreation facilities or unique natural and special features;
      (3)   The location of the park land to be dedicated;
      (4)   The approximate time when development of the park or recreation facility shall commence.
   (B)   In making its final determination, the Plan Commission shall be guided by the standards contained in §§ 155.034 through 155.040. After making its final determination, the Plan Commission shall give notice to the subdivider, the Town Council, and any other interested party.
   (C)   Prior to the time of the signing of the final plat of subdivision, the subdivider shall dedicate the land as previously determined by the Plan Commission.
   (D)   Open space covenants for private park or recreational facilities shall be submitted to the Plan Commission prior to primary approval and shall be recorded contemporaneously with the final plat of subdivision.
