§ 31.39 CODE ENFORCEMENT OFFICER.
   (A)   Enforcement. There is hereby created the nonelective office of Code Enforcement Officer,for the City of Windy Hills.
   (B)   Term. The Code Enforcement Officer shall hold office for the term of one year beginning on the second Monday of January.
   (C)   Oath. Before entering office, the Code Enforcement Officer shall take the oath as prescribed by § 228 of the Kentucky Constitution.
   (D)   Bond. The Code Enforcement Officer shall not be required to post bond.
   (E)   Qualifications. The Code Enforcement Officer shall be at least 21 years of age and of good moral character, and shall possess such professional training and experience to ensure competent performance of the duties of the office. Residency within the city shall not be required, although residents shall be preferred. No person who has been convicted of a felony is eligible for appointment.
   (F)   Salary. The salary of the city Code Enforcement Officer is fixed by ordinance, or as otherwise directed by the City Council. The current salary is fixed by Municipal Order #2, Series 2015/2016.
   (G)   Powers and duties. The city Code Enforcement Officer shall have the same powers as those belonging to a citation officer set forth in KRS 83A.087. The powers and duties of a Code Enforcement Officer shall include the following:
      (1)   The power to issue citations upon observance of non-moving motor vehicle offenses;
      (2)   The power to issue citations upon observance of violations of ordinances except for moving motor vehicle offenses and except for offenses which constitute a violation of the state’s Penal Code;
      (3)   Know the city’s codes;
      (4)   Make periodic inspections throughout the city;
      (5)   Meet with residents to resolve issues pertaining to interpretation of the codes;
      (6)   Recommend liens when appropriate; and
      (7)   Report to the City Council monthly.
   (H)   Limitations on powers. The Code Enforcement Officer shall not have the powers of a peace officer to make arrests or carry deadly weapons. Nothing contained herein shall limit the power of a Code Enforcement Officer to make an arrest as a private person as provided in KRS 431.005.
