§ 52.32 BILLING ADJUSTMENTS.
   (A)   Any customer experiencing an unusual spike in his or her monthly utility due to a leak or failure may appear before the Council at a regularly scheduled meeting and present a request for a utility billing adjustment.
   (B)   The town may, in its discretion, determine that a fault or failure has occurred which resulted in an unusually high utility billing for the month for the customer seeking an adjustment.
   (C)   (1)   If the town determines that such a fault or failure has occurred, the town may issue a billing adjustment one time per year per utility to relieve the customer of some portion of the excessive billing.
      (2)   Adjustments may not be issued merely for high use by a customer in a given month, and any adjustment should be supported by a determination as to the cause of the unusual use.
   (D)   If determined to be appropriate, the town may issue a credit towards an excessive billing based on a three-month average use figure for that customer.
