§ 91.24 HUMANE TREATMENT.
   Every owner or harborer within the town shall see that each of his or her animals:
   (A)   Is kept in a clean, sanitary, and healthy manner, and is not confined so as to be forced to stand, sit, or lie in its own excrement;
   (B)   Has sufficient and wholesome food and water which is proper and nutritional for that species of animal;
   (C)   Has a proper and adequate structure provided that will protect that animal from all elements of the weather and will allow that animal to stand, sit, and lie down without restriction;
   (D)   Has easy access in and out of its structure;
   (E)   Has an opening on its structure on no more than one side that allows the animal to remain dry and has a floor that is level, dry, and raised, if necessary, to prevent water/snow from entering the structure;
   (F)   Has a solid roof sloped away from the entrance, be free from cracks, depressions, and rough areas that might be conducive to insects, parasites, and other pests;
   (G)   Has a structure of adequate size to allow the animal to stand erect with the animals’s head up, turn around easily, and to sit and lie down in a comfortable and normal position;
   (H)   When the temperature is 80 degrees or higher, or whenever appropriate for a particular dog’s breed, age, body, and health condition, offer adequate shade during daylight hours, provided by trees, a tarp, or other means, that prevents overheating or discomfort to the animal;
   (I)   When the temperature is 32 degrees or lower, or whenever appropriate for a particular dog’s breed, age, body, and health condition, include sufficient, dry bedding material or other means of protection from the weather that will allow the animal to retain body heat when the weather is colder than what an animal of that breed and condition can comfortably tolerate;
   (J)   If ill, diseased, or injured, receives proper veterinary care as necessary to promote the good health of the animal and prevent the transmittal of a disease to other animals or human beings;
   (K)   Is not abandoned, neglected, or tortured;
   (L)   If a dog over the age of six months, is properly vaccinated against rabies annually pursuant to I.C. 35-46-3-1; and
   (M)   Is not tethered by use of a choke collar or on a leash less than 12 feet in length or of such weight as to prevent the animal from moving about freely.
