(A) Definitions. The definitions for this section are the same as those found in I.C. 5-16-9-1, or as said section may be amended from time to time.
(B) Disabled parking spaces placement. Parking places shall be either:
(1) In accordance with Indiana State Code; or
(2) Any place designated by the city as a disabled parking space.
(C) Dimensions and marking disabled parking spaces. Disabled parking spaces dimensions and marking shall be done in accordance with Indiana State Code. The city shall designate certain areas as disabled parking space, and erect and maintain the appropriate signage on or adjacent to said disabled parking spaces.
(D) Violations.
(1) Any person who parks a motor vehicle which does not have a valid and unexpired registration plate, placard, or decal for a person with physical disability or for a physically disabled veteran, issued under the law of the State of Indiana, or under the laws ox another state, in a parking space reserved under this section for a person with a physical disability, shall be deemed to be in violation of this section.
(2) Any person who knowingly parks in a space reserved for a person with a physical disability while displaying a placard, decal or registration plate to which neither the person nor the person's passenger is entitled, shall be deemed to be in violation of this section.
(3) Any person who displays for use in parking in a reserved space for a person with a physical disability a placard or a special license plate that was not issued by the state or under the laws of another state shall be deemed to be in violation of this section.
(4) A person who, in a parking space reserved for a person with a physical disability, parks a vehicle that displays a placard or a special registration plate to park in a parking space reserved for a person with a physical disability, if that person is not at that time in the process of transporting a person with a physical disability shall be deemed in violation of this section.
(E) Enforcement. The provisions of this section may be enforced as follows:
(1) Any person violating division (D)(1), (2), or (3) of this section may be issued either:
(a) A citation for the commission of a Class C infraction; or
(b) A citation for the violation of the local ordinance herein established.
(2) Any person violating division (D)(3) of this section may be issued either:
(a) A citation for commission of a Class C misdemeanor; or
(b) A citation for the violation of the local ordinance herein established.
(3) Officers of the Police Department shall have authority to issue citations for the violation of parking provisions contained in this division.
(4) Each day the violation continues constitutes a separate offense.
