§ 39.08 FEE FOR PROVIDING RECORDS TO THE PUBLIC.
   (A)   The city shall charge for providing a duplicate of a computer tape, computer disc, microfilm, law enforcement recording, or similar or analogous record system containing information owned by the city or entrusted to it, as follows:
      (1)   A video length under 29 minutes and under: $50;
      (2)   A video length 29 minutes to 59 minutes: $100; and
      (3)   A video length 60 minutes or longer: $150.
   (B)   Provided however, the above charge is not more than the city’s direct costs in providing the information. Direct costs are defined under I.C. 5-14-3-2(d) and means 105% of the sum of the cost of: the initial development of a program, if any; the labor required to retrieve electronically stored data; and any medium used for electronic output; for providing a duplicate of electronically stored data onto a disk, tape, drum, or other medium of electronic data retrieval under section I.C. 5-14-3-8(g), or for reprogramming a computer system under section I.C. 5-14-3-6(c). If the direct costs are less than the above stated costs then the city shall charge the direct costs for providing the requested information.
   (C)   The fees colleted are to be deposited in the city’s General Fund.
