§ 71.02 LIMITED DURATION PARKING ZONES.
   (A)   The Town Council of the Town of Winamac, Indiana, hereby identifies the following parking spots as "15 Minute Parking" zones due to the need for open parking spaces in front of public buildings, to alleviate traffic congestion, and for the health, safety and welfare of town residents:
      (1)   Eight parking spots located in front of the Town Hall, including one handicap parking spot and seven non-handicap parking spots. These parking spots will be further identified by proper signage, indicating that the given spots are "15 Minute Parking" spots only.
   (B)   The Town Council hereby appoints the following individuals as the enforcement authorities for the town, as it pertains to enforcement of this section:
      (1)   The Town Police Department, through any of its officers;
      (2)   The Pulaski County Sheriffs Department;
      (3)   Any other agent of the town, that has been duly authorized by a vote of the majority of the Town Council, at a meeting open to the public.
   (C)   Penalties. Penalties for any violation of this section, shall be assessed, as follows:
      (1)   First offense: $25.
      (2)   (a)   Second offense: $50.
         (b)   For purposes of this section, an offense shall be considered a second offense, if the commission of the second offense occurs within 180 days following the first offense. If any repeat violation occurs outside of this 180-day window, that violation shall be considered a first offense.
      (3)   (a)   Additional offenses: $100 per offense.
         (b)   For purposes of this section, an offense shall be considered an additional offense, if the commission of the additional offense occurred within 90 days following either the second or previous additional offense. If any repeat violation occurs outside of this 90-day window, that violation shall be considered a first offense.
   (D)   Nothing in this section shall prohibit the town from having any vehicle in violation of this section towed, at the owner, operator, or licensee's expense, provided that the town has adhered to proper statutory procedure.
