§ 31.16 RELATIONSHIP BETWEEN NEED FOR ADDITIONAL PUBLIC FACILITIES AND TYPE OF GROWTH.
   (A)   The City Council is committed to maintaining or improving the same level of public facilities and services and the same public facilities to population relationship which existed on 12-19-2005, the date of adoption of Ord. 554-05, creating and establishing a growth impact fee, in order to ensure that to the extent city growth occurs in the future, there will be the same level of public facilities and services that existed on 12-19-2005.
   (B)   (1)   The City Council has determined that residential growth results in significant increases in city population, and that residential growth adversely affects the public facilities-to-population relationship which existed on 12-19-2005.
      (2)   The City Council has further determined that because residential development results in significant increases in population, this growth results in the need for additional public facilities.
      (3)   Based on the public facilities-to-population relationship which existed on 12-19-2005, and the extent to which residential development contributes to the city’s growth, the City Council determines that residential growth should be assessed at the following rate as their fair share of contribution for the costs for these required public facilities:
         (a)   A fee of $3,000 for each new residential unit constructed on property that was annexed into the city limits after 12-19-2005;
         (b)   A fee of $1,500 for each new residential unit constructed on property that was within the annexed city limits prior to 12-19-2005; or
         (c)   For any residential unit that is constructed on property that was within the annexed city limits prior to 12-19-2005, but for which a zone amendment is requested that increases the zone density (i.e., R-1 to R-2, R-1 to R-3, R-2 to R-3 and the like), or for which a zone amendment is requested that changes the designation from non-residential to residential (i.e., business or professional to residential), then the fee will be $3,000 per unit for each new unit of residential construction.
