§ 151.02 STREET EXCAVATIONS AND DIGGING.
(A)   (1)   Any person, firm or corporation to whom a permit shall be granted to make an excavation in any street in the city shall be required to make a deposit with the City Clerk in the amount of not less than $25, nor more than $50, depending on the size of the excavation to be made.
   (2)   The deposit shall be refunded at such time as the Street Committee of the City Council shall be satisfied that the street is in as good repair as it was before the excavation was made.
   (3)   If the person, firm or corporation making any excavation in any street shall fail to repair said street to the satisfaction of the Street Committee of the City Council, the deposit made shall be retained by said city and used by said city to make repairs necessary.
(B)   It shall be unlawful for any person, firm or corporation to dig up or otherwise deface any permanent street in the city for any purpose whatsoever without first having secured a permit from the City Council.
