§ 30.31 CITY ATTORNEY.
   (A)   The City Attorney, as he or she may hereafter be appointed shall be compensated for services to the city according to the following schedule.
      (1)   For any required action relative to any day-to-day, normal activity of any branch of government of the city, which shall include, but not be limited to, meetings with the City Council, advising, at any time, any of the branches of government with respect to problems, difficulties, duties, obligations and actions of each, and drafting of any documents necessary to accomplish and complete the normal business of government, said City Attorney shall be paid in an amount set by the City Council.
      (2)   For any extraordinary activity which shall include, but not be limited to, bond issuance, condemnation proceedings, civil suits, annexations, appellate proceedings or any other matters not commonly encountered in the ordinary course of business of said city, the City Attorney shall be paid the sum of in an amount set by the City Council per hour.
      (3)   For any and all necessary actions to enforce payment of delinquent taxes or accounts owed to said city, the City Attorney shall be paid a fee equal to 25% of any sums collected.
   (B)   (1)   The City Attorney shall serve as delinquent Tax Collector for all property taxes that become delinquent. The City Clerk and/or City Treasurer shall turn over to the City Attorney’s office all delinquent taxes for the previous property tax year on February 1. The City Attorney will then promptly seek to recover all such taxes and is authorized to use whatever legal process, including the initiation of a lawsuit if necessary, to collect same. All taxes collected by the City Attorney will be promptly paid to the City Treasurer for proper credit. The City Attorney shall be additionally paid a fee of 25% of all delinquent property taxes, penalty and interest paid after June 1 for the previous tax year with a minimum of $75 per tax bill. Said additional fees shall be paid by the taxpayer. If litigation is required, the court shall determine and order a reasonable attorney fee for the City Attorney service rendered in the collection of the tax.
      (2)   The City Attorney is authorized to initiate litigation against any and all individuals owing delinquent tax bills when said bills are turned over to the City Attorney by the City Clerk on February 1 of each year.
