§ 90.05 TREE MAINTENANCE IN PUBLIC RIGHTS-OF-WAY.
   (A)   Owners of street trees shall provide reasonable care and maintenance to trees within the public right-of-way or tree planting easement, including as appropriate, watering, pruning, insect control and removal of dead or diseased limbs.
   (B)   Owners or occupants of any building or lot zoned residential may not permit any tree, including street trees, to grow in a manner that interferes with a normal sidewalk located on such lot or on a public right-of-way adjoining such lot, or street traffic, or to grow so as to pose a threat to safety or public rights-of-way due to obstruction of view, obstruction of passage or in any other manner.
   (C)   The minimum clearance of any overhanging portion thereof shall be seven feet over sidewalks and 12 feet over all streets, except truck routes that shall have a clearance of 14 feet.
   (D)   Any person who removes a tree on the public right-of-way shall replace the removed tree in accordance with the requirements and specifications set forth in § 90.09 of this chapter with a tree from the list of “desirable trees” from the list in § 90.12 of this chapter or as approved by the Tree Board. The Tree Board may waive this requirement where replacement would be inappropriate under the standards set forth in § 90.09 of this chapter.
