(A) A Tree Board, appointed by the Mayor, shall be established. The Tree Board shall consist of five concerned and interested citizens of the city or the county, including the following:
(1) One member shall be a professional in the tree field, preferably a landscape architect or a Certified Arborist, ISA (International Society of Arboriculture) certified;
(2) Another member shall be actively engaged in horticulture;
(3) The representative from Public Works, as well as Parks and Recreation, shall be the Community Tree Manager;
(4) A member of the Community Development Board; and
(5) The Arbor Day Chairperson from the Community Development Board.
(B) The representative of Public Works and Parks shall be a permanent member of the Board through his or her city employment in these capacities. All other Tree Board members shall serve staggered terms of four years.
(C) In the event a vacancy shall occur during the term of any appointed member, a successor shall be appointed for the expired portion of the term. All members of the Tree Board shall serve without pay.
(D) The Tree Board shall establish the Board’s rules, regulations and procedures and arrange for the holding of meetings on a regular basis, with no less than four meetings per calendar year. Three or more members of the Tree Board shall constitute a quorum and a majority of those present can take action on any business at hand.
(E) The duties of the Tree Board shall be as follows:
(1) To establish guidelines, offer advice and provide guidance for tree planting in the city;
(2) To work with new development representatives to ensure that this chapter is carried out;
(3) To advise persons on matters of tree planting, care, preservation, planning, removal and replacement, as well as the disposition of trees in parks, along streets and in public areas as needed;
(4) To promote urban forestry;
(5) To assist the city government in protection, care and maintenance of city trees; and
(6) To oversee the city tree nursery.
(F) The City Council shall have the right to review the conduct, acts and decisions of the Tree Board. Any person may appeal any ruling or order of the Tree Board to the City Council who may hear the matter and make the final decision.
