The type, capacities, location and layout of a private wastewater disposal system shall comply with all requirements of the Department of Public Health of the commonwealth or applicable federal law. No construction shall be allowed for any private wastewater disposal system employing subsurface soil disposal facilities where the area of the lot is less than 200 square feet. Septic tank or cesspool discharges require the use of subsurface disposal. This requirement excludes deep well disposal as defined by state and federal laws.
