§ 51.32 MAINTENANCE ASSESSMENTS.
   (A)   Every city water customer in service areas outside the city limits (i.e., they do not pay a city property tax) who are within 1,000 feet of a fire hydrant, will pay a monthly maintenance assessment for the fire hydrant.
   (B)   This assessment will be $10 per month at the time this subchapter is adopted. All assessed customers will be charged the same monthly rate.
   (C)   (1)   This rate shall increase in proportion to any increases approved for the city’s water rates.
      (2)   For example, if the City Council increases the base line water rate 1%, then the maintenance assessment will increase 1%, effective the same time as the water rates are increased; if a 2% water rate increase, then a 2% assessment increase and the like.
   (D)   Payment of the maintenance assessment will be required every month that there is an open water account, regardless of the amount of water usage. This assessment will be a line item on the customer’s monthly water bill, and will be subject to all procedures for billing and collections supported by city ordinance, including termination of water service for non-payment.
   (E)   All property that is developed in the county, which is proposed with fire hydrants that will connect to the city’s water system, must include the following language on the final record plat recorded with the Joint Planning Commission, and also on any deed of restrictions for the development: “All water customers of the City of Wilmore who live in a service area outside Wilmore’s city limits, and who live within 1,000 feet of a fire hydrant, must pay a monthly maintenance assessment fee for the fire hydrant to the City of Wilmore as per Ordinance 570-06.”
   (F)   These assessments shall apply from this date forward and shall continue in full force and effect until repealed or modified as required by law.
   (G)   The maintenance assessment will be eliminated for any customer whose property is annexed into the city limits.
