It shall be unlawful for any person to distribute, deposit, place, throw, scatter, or cast any handbill, circular, leaflet, pamphlet, or other printed or similar written matter upon any private premises, if requested by anyone thereon not to do so, or if there is placed on said premises a sign bearing the words: "No Solicitors Invited", "No Advertisements", or any similar notice, indicating in any manner that the occupants of said premises do not desire to be molested or to have their right of privacy disturbed, or to have any such items left upon such premises. Such notice shall be in the form of a weatherproof card, approximately three inches by four inches (3" x 4") in size, with letters at least one-third inch (1/3") in height. Such notice shall be exhibited upon or near the main entrance door to the premises. For the purposes of uniformity, the cards shall be provided by the Chief of the Police Department to persons requesting same, at cost.
It shall be the duty of every person, upon going onto any private premises for the purposes of distributing, depositing, placing, throwing, scattering or casting any handbill, circular, leaflet, pamphlet or other printed or similar written matter, to first examine the premises for the notice provided for above, and if such notice is present, to immediately and peacefully depart from the premises.
The provisions of this section shall not apply to the distribution of mail by the United States or to the delivery of newspapers. (Ord. 01-O-08, 3-12-2001)
