5-3-15: NUISANCES:
It shall be unlawful for any person to permit or maintain any nuisance on any property under his control. As used herein, the term "nuisance" is defined to mean any condition or use of premises or of building exteriors which is detrimental to the property of others or which causes or tends to cause substantial diminution in the value of other property in the neighborhood in which such premises are located. This includes, but is not limited to, the keeping or the depositing on, or the scattering over the premises of any of the following: a) lumber, junk, trash or debris; b) abandoned, discarded or unused objects or equipment such as automobiles, furniture, stoves, refrigerators, freezers, cans or containers.
   (A)   Duty Of Maintenance Of Private Property: No person owning, leasing, occupying or having charge of any premises shall maintain or keep any nuisance thereon, nor shall any such person keep or maintain such premises in a manner causing substantial diminution in the value of the other property in the neighborhood in which the premises are located.
   (B)   Dumping Of Junk Prohibited: No person shall abandon, discard or dump any trash, debris or other objects or equipment as defined in this section upon the property of another.
   (C)   Exterior Storage Of Nonoperating Vehicles Prohibited: No person in charge of or in control of premises, whether as owner, lessee, tenant, occupant or otherwise shall allow any partially dismantled, wrecked, junked, discarded or otherwise nonoperating motor vehicle to remain on such property longer than ten (10) days; and no person shall leave any such vehicle on any property within the Village for a longer time than ten (10) days; except that this section shall not apply with regard to any vehicle in an enclosed building or so located upon the premises as not to be readily visible from any public place or from any surrounding private property. This chapter shall further not apply with regard to any vehicle on the premises of a business enterprise operated in a lawful place, other than in a residential district, and operated in a lawful manner, when the keeping or maintenance of such vehicle is necessary to the operation of such business enterprise; or with regard to a vehicle in an appropriate storage place or depository maintained in a lawful place and manner by the Village or any other public agency or entity.
   (D)   Removal Of Obstructions To Waterways: The Corporate Authorities may remove or cause to be removed, in such manner as they may direct, any lumber, junk, trash, debris, automobiles, furniture, stoves, refrigerators, freezers, cans, containers or driftwood or other obstructions from natural or other watercourses, causing flooding of any part of the corporate areas, whether such obstructions are located inside or outside the corporate limits, and may for that purpose, after written notice to the owner at least ten (10) days prior thereto, enter upon the lands or waters of any person for the purpose of removing such obstruction.    (E)   Activities Prohibited During Certain Hours: The owner and/or occupant of any premises shall not permit any of the following activities to be conducted on said premises, nor shall any person engage in any of the following activities, from ten o'clock (10:00) P.M. to six o'clock (6:00) A.M. within six hundred feet (600') of any residential boundary:
      1.   The collection, pickup or disposal of refuse, recyclable materials, landscape waste, empty containers, drums, etc., or any other reusable product or device, except when conducted entirely within a completely enclosed building;
      2.   The sweeping or cleaning of any parking lot or sidewalk by any mechanical means;
      3.   The shipping or receiving of any goods, merchandise or any other materials, except when conducted entirely within a completely enclosed building; or
      4.   Any other outdoor maintenance activity requiring the use of any mechanical device; in addition, and notwithstanding any provision of this subsection to the contrary, such outdoor maintenance activity shall not be permitted from six o'clock (6:00) A.M. to eight o'clock (8:00) A.M. on Saturdays and/or Sundays.    (F)   Animals Prohibited: No person shall raise or maintain any livestock, fowl, poultry or other animal(s) which produces or emits any offensive noise or odor which disturbs the peace and quiet of the neighborhood or annoys persons in the neighborhood of ordinary sensibilities.    (G)   Noise: In addition to the other provisions of this section, the following act, conduct or condition is hereby declared and defined to be a nuisance: to produce or permit to be produced, whether on private or public property, any unreasonable noise to the disturbance of the peace or quiet of any person residing in the vicinity. For purposes of this subsection, the owner, lessee, occupant, or any agent thereof, of any private property on which any unreasonable noise has occurred, shall be presumed to have permitted such unreasonable noise to occur. Such presumption shall be rebuttable.
   (H)   Penalty; Enforcement Of Section: Any person found to have violated any subsection of this section may be prosecuted in accordance with the provisions of section 1-4-1 of this Code. (Ord. 97-O-04, 1-27-1997)
