339.025 WEIGHT PROVISIONS FOR FARM AND LOG TRUCKS AND FARM MACHINERY.
   (a)   As used in this section:
      (1)    "Agricultural Tractor" has the same meaning as in Section 301.02 of the Codified Ordinances.
      (2)    "Farm commodities" includes livestock, bulk milk, corn, soybeans, tobacco, and wheat.
      (3)    "Farm truck" means a truck used in the transportation from a farm of farm commodities when the truck is operated in accordance with this section.
      (4)    "Log truck" means a truck used in the transportation of timber from the site of its cutting when the truck is operated in accordance with this section.
      (5)    "Coal truck" means a truck transporting coal from the site where it is mined when the truck is operated in accordance with this section.
 
   (b)    Notwithstanding Sections 339.021 and 339.023 of the Codified Ordinances, a coal truck transporting coal, a farm truck or agricultural tractor transporting farm commodities, or a log truck transporting timber, from the place of production to the first point of delivery where the commodities are weighed and title to the commodities, coal, or timber is transferred, may exceed by no more than seven and one-half percent (7.5%) the weight provisions of this chapter and no penalty prescribed in Section 339.99 of the Codified Ordinances shall be imposed. If a coal truck so transporting coal, a farm truck or farm machinery so transporting farm commodities, or a timber truck so transporting timber, exceeds by more than seven and one-half percent (7.5%) the weight provisions of this chapter, both of the following apply without regard to the seven and one-half per cent allowance provided by this division:
      (1)    The applicable penalty prescribed in Section 339.99;
      (2)    The civil liability imposed by Section 339.14 of the Codified Ordinances.
 
   (c)    (1)    Subsection (b) hereof does not apply to the operation of a farm truck, log truck, or farm machinery transporting farm commodities during the months of February and March.    
      (2)    Regardless of when the operation occurs, subsection (b) hereof, does not apply to the operation of a coal truck, a farm truck, a log truck, or farm machinery transporting farm commodities on either of the following:
         A.   A highway that is part of the interstate system.
