135.38 ONEOHIO OPIOID SETTLEMENT SPECIAL REVENUE FUND.
   (a)    Retroactive to July 15, 2022 there is hereby created a fund to be known as the OneOhio Opioid Settlement Special Revenue Fund to account for the receipt and expenditure of moneys received as part of the OneOhio Opioid Settlement.
   (b)    Revenue credited to the OneOhio Opioid Settlement Special Revenue Fund shall be used to cover expenses that:
      (1)   Consistent with the "Approved Purposes" definition in the OneOhio Memorandum of Understanding (MOU); and
      (2)    Are consistent with the Ohio Opioid Abatement Strategies detail in Exhibit A of the OneOhio Memorandum of Understanding; and
      (3)    The City may reimburse itself for expenditures incurred prior to July 15, 2022 that are consistent with the settlement's approved purposes definition.

   (c)    The OneOhio Opioid Settlement Special Revenue Fund is established in accordance with Ohio Revised Code Section 5705.09 Establishment of Funds, Subsection (F) which requires a political subdivision to establish a special revenue fund for each class of revenues derived from a source other than the general property tax which the law requires to be used for a particular purpose. As the OneOhio Opioid Settlement Agreement restricts the use of the settlement moneys, the City has the inherent authority to establish a new fund without seeking approval of the Auditor of the State.
