1501.99 PENALTY.
   (a)    Whoever violates or fails to comply with any provision of this chapter upon conviction of the first offense shall be deemed guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars or imprisoned not more than sixty days, or both for each offense. Any person convicted of subsequent violation of this chapter shall upon conviction shall be deemed guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars or imprisoned not more than six months or both for each offense. Such person shall be deemed guilty of separate offenses for each day, every day, or portions thereof during which any violation of the provisions of this chapter is committed, permitted, or continued.
 
   (b)    The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
 
   (c)    The imposition of any penalties provided herein shall not preclude the Law Director from instituting an appropriate action or proceeding in a Court of proper jurisdiction to prevent unsafe conditions, or to restrain, correct, or abate violation, or to require compliance with chapter or other applicable laws, ordinances, rules or regulations, or the orders of the Fire Chief.
