923.01 SEWER RATE CHARGES ESTABLISHED.
   (a)   There is hereby established a charge for the use of central sanitary sewers in the City which are served by the Euclid Sewerage Treatment Plant,

   (b)   The charge established in subsection (a) hereof is necessary to provide funds for the cost of maintenance, repair and capital improvements to the sanitary sewerage lines in the City, sewage treatment and the use of sanitary sewerage lines outside of the City.

   (c)   The sanitary sewerage charge shall be the sum of the rates imposed by the cities of Euclid and Willoughby Hills at a rate as follows for each one thousand (1,000) cubic feet of water consumed on each lot, parcel of land or premises connected with, or which is in the future connected with, the sanitary sewerage system of the City as such water consumption is measured by the water meter reading.
  
Willoughby Hills Operating Rate:
The rate for maintenance, repair, operations and capital improvement of the sanitary sewage system shall be $40.26 per one thousand (1,000) cubic feet of water consumed on each lot, parcel of land or premise connected with the sanitary sewage system.
Euclid Processing Rate:
In addition to the Willoughby Hills sewer rate, Euclid's sewer treatment charges will be that in effect by ordinance adopted from time to time by the City of Euclid per the original Agreement with the City of Willoughby Hills dated April 1, 1998 and the several amendments subsequent to that date.
Administrative Fee:
In addition to the Willoughby Hills and Euclid rates, there is a fixed administration fee equal to the fixed fee charged the City by the Lake County Department of Utilities for water meter reading and billing services. This fee shall be added to each quarterly sewer bill issued by the Lake County Department of Utilities.
Minimum Charge:
Notwithstanding anything contained herein to the contrary, the minimum sanitary sewerage charge shall be the rate charged for five hundred (500) cubic feet of water used plus the Lake County Department of Utilities Administration Fee.
   (d)   New sewer rates shall be effective in 2018 on the water consumption meter reading date performed by the Lake County Department of Utilities that includes April 1st. Subsequent sewer rate changes shall be effective on the water consumption meter reading date that includes January 1st of the year the change is to be effective unless otherwise specified in the legislation authorizing the rate change.

   (e)   Effective Date:
      Each increase is effective January 1st of each year.
   Notwithstanding anything contained herein to the contrary, the minimum sanitary sewerage charge shall be the rate charged for one thousand feet of cubic water used.

   (f)   Residential Summer Sprinkling Program. Notwithstanding (c) and (d) above, a residential summer sprinkling program is hereby established for the authorized service area of the Euclid Sewer District in accordance with the following provisions:
      (1)   Definitions – wherever they are used in this Subsection, the meaning of these terms shall be as defined as follows:
         A.   “Summer Residential Sprinkling User Charges” (SRSUC) – shall mean    the vehicle by which the City shall assess sewer service charges to eligible residential users defined herein.
         B.   “Summer Billing Period” – shall mean the period between May 1 and September 30, inclusive.
         C.   “Winter Billing Period” – shall mean the period between October 1 and April 30, inclusive.

         D.   “Eligible User” – shall mean any owner occupied one, two, three, or four family residences, excluding condominiums and apartments, within the authorized service area of the Euclid Sewer District where Sewer Service Charges are based upon water consumption. Residences where Sewer Service Charges are based upon sewer meters are not eligible.

         E.   “Winter Billing Period Usage” – shall mean the calculated daily consumption during the winter billing period.
      (2)   Summer Residential Sprinkling User Charges – upon receipt of a timely application submitted therefore, the City of Willoughby Hills shall provide Summer Sprinkling User Charges to Eligible Users. These charges shall be provided by basing the sewer charges during the summer billing period on the smaller of either the actual water consumption or a calculated consumption based upon winter billing period usage.
      (3)   Application for Summer Residential Sprinkling User Charges – an application for Summer Residential Sprinkling User Charges (SRSUC) must be made by an Eligible User via the application provided by the City and shall be in such form and contain such information as required by the City. The application together with a one time twenty dollar ($20.00) fee must be submitted to the City by September 1 of any year to be eligible. The SRSUC will continue from year to year unless otherwise cancelled according to the provisions herein.
      (4)   Removal from Summer Residential Sprinkling User Charges – upon the change of ownership of any property to rental property, that property’s Summer Residential Sprinkling User Charges will be cancelled. A new application and a twenty dollar ($20.00) fee must be submitted by any subsequent Eligible User. Additionally, Summer Residential Sprinkling User Charges shall be cancelled due to errors or falsifications on the application.
      (5)   Establishing Program – the Mayor is hereby authorized to enter into an agreement with the Lake County Department of Utilities to create the necessary software for programming winter averaging and establishing Summer Residential Sprinkling User Charges. The Director of Finance is hereby authorized to pay for such programming from the Sewer Service Fund, Account #610. At such time and to the extent that software programming necessary to apply the regulations is in place, eligible users may apply to the City of Willoughby Hills on applications pursuant to the regulations adopted by the City which shall have the force and effect of an ordinance.

   (g)   In addition to the sanitary sewer charges established herein, there is hereby established an additional sanitary sewer charge, to be billed quarterly by the Lake county Utilities Department, in the amount of one dollar ($1.00) for each one-thousand (1,000) cubic feet of water consumed for the following parcels of land: Permanent Parcel No. #31-A-008-0-00-004-0, Permanent Parcel No. #31-A-008-0-00-005-0, Permanent Parcel No. #31-A-025-0-00-040-0 and Permanent Parcel No. #31-A-025-0-00-048-0.
