909.06 CULVERT RECONSTRUCTION, NOTICE AND COST.
   If the Director of Public Service determines that a culvert, as installed, is not properly functioning because of improper sizing, installation or subsequent damage, he shall serve written notice upon the property owner for the removal and/or correction of such culvert. In the event that the property owner fails to remove or otherwise improve the culvert so as to cause such culvert to function properly within thirty days after service of such notice, the Director shall make such corrections as, in his discretion, are necessary to cause such culvert to function properly. The charges for the correction of such culvert shall be forwarded to the property owner and are made a lien on the corresponding lot, land or premises upon which such culvert is situated, and if such charges are not paid within thirty days after due and payable, they shall be certified to the Auditor of Lake County, who shall place the same on the tax duplicate of Lake County with interest and penalties allowed by law, and such charges shall be collected as other taxes are collected.
