(a) A minor violating Section 553.01 is guilty of curfew violation, a third degree misdemeanor. If the offense results in physical harm to any person(s) or damage to any property, or if the offender has been previously convicted of curfew violation, then a violation of the section becomes a second degree misdemeanor.
(b) Any parent or guardian who is found to be knowingly in violation of 553.02 is guilty of a third degree misdemeanor. If said parent or guardian has a prior conviction for the offense, said parent/guardian shall be guilty of a second degree misdemeanor.
