This article shall not apply to or include the following:
(a) The sale of used or secondhand goods where all of the following are present:
(1) The incidental sale of goods is held on property occupied as a dwelling by the seller or owner, such as yard sale, garage sale or moving sale;
(2) The items offered for sale are owned by the occupant or seller; and
(3) The sale does not exceed a period of 96 consecutive hours.
(b) The sale of used or secondhand goods by any not-for-profit or charitable organization;
(c) The sale of used or secondhand books or magazines;
(d) The sale of goods at an auction held by a licensed auctioneer; and
(e) The sale of used or secondhand goods sold at the public market, such as a farmers market.
