§ 31.07 FIRE CHIEF.
   (A)   Election of officers. The Fire Chief shall be elected by the member of the Fire Department, with the approval of the Mayor and Council. Other officers are elected by the members of the Fire Department.
   (B)   Supervision. The Fire Chief shall be head of the Fire Department and have supervision over all officers and members thereof.
   (C)   Duties and responsibilities of Fire Chief. The Fire Chief shall keep such records and make such reports concerning the activities of his or her department as may be required by the statute or by the Mayor and Council. He or she shall be responsible for the performance of the Fire Department and of its functions, and all persons who are members of the Fire Department shall serve subject to his or her orders. He or she shall be responsible for the control and custody of all Fire Department property and equipment and shall have the authority of a law enforcement officer while actively engaged in fighting a fire or en route to or from a fire.
