§ 53.15 USE OF GROUNDWATER AS A POTABLE WATER SUPPLY PROHIBITED.
   (A)   Prohibition. On and after the effective date of this section, no person shall use or attempt to use as a potable water supply groundwater from within the area designated as a Restricted Groundwater Zone, within the corporate limits of the County of Will, as a potable water supply, by the installation or drilling of wells or by any other method. This prohibition expressly includes the County of Will.
   (B)   Restricted groundwater zone.
      (1)   The following properties shall be designated a Restricted Groundwater Zone:

      (2)   Figure 1, attached to Ordinance 23-113 and incorporated herein by reference, illustrates the area of the Restricted Groundwater Zone. Attachment A, attached to Ordinance 23-113 and incorporated herein by reference, contains the Global Positioning System coordinates along the portion of 14944 West Hoff Road.
   (C)   Definitions. For purposes of this section the following definitions shall apply:
      PERSON. Any individual, partnership, co-partnership, firm, company, limited liability company, corporation, association, joint stock company, trust, estate, political subdivision, or any other legal entity, and any of its or their legal representatives, agents or assigns.
      POTABLE WATER. Any water used for human or domestic consumption, including, but not limited to, water used for drinking, bathing, swimming, washing dishes, preparing foods, watering lawns, or watering gardens in which produce intended for human consumption is grown.
   (D)   Penalties. Any person violating the provisions of this section shall be subject to a fine of up to $750 for each violation. Each day of the continued existence or use of a prohibited well shall be considered a separate violation.
