§ 71.02 GENERAL PROVISIONS.
   (A)   The Highway Commissioner of each township, and the County Superintendent of Highways are authorized to designate streets and roads under their respective jurisdictions as snow routes.
   (B)   Parking is prohibited on any designated snow routes during snow removal operations where snowfall has reached an accumulation of two or more inches in the road right-of-way.
   (C)   The Township Highway Commissioner or County Superintendent of Highways is authorized to tow or cause to be towed to a suitable storage area, any vehicle along a snow route which is in violation of this chapter and the vehicle shall be impounded until lawfully claimed.
      (1)   The owner of the impounded vehicle, under the provisions of this chapter, shall be charged a fee in a sum sufficient to cover the charges and expenses for towing and storage of the vehicle; the fee shall be payable to the contracted agent and contractually agreed upon with the Township Highway Commissioner or the County Superintendent of Highways, whichever is applicable.
      (2)   The fee may be paid prior to the release of the vehicle impounded, or billed to the owner of the vehicle.
   (D)   When a vehicle requires towing, the Commissioner or Superintendent shall notify the contracted agent orally, and subsequently by documentation in triplicate, of requested action. This oral and subsequent written notification shall also be forwarded to the County Sheriff’s Department.
      (1)   This notification shall indicate the year, make, model, color and license registration number; and the time, date and location of removal of the vehicle.
      (2)   The County Sheriff’s Department shall also have in its possession, a list of the contracted towing agents and designated snow routes in the county.
   (E)   A written agreement shall be consummated between the contracted agent and either the Township Highway Commissioner or the County Superintendent of Highways, whichever is applicable. This agreement must meet the approval of the County Sheriff’s Department. With the execution and delivery of this agreement, each of the participating agents agrees to indemnify and hold the county and its townships harmless against any claim or claims, meritorious or otherwise, for any loss, personal injury, death or damages that may arise in connection with or result from the towing of vehicles during snow removal operations.
