(A) Pursuant to ILCS Ch. 55, Act 5, § 5-1062(b), a community that is located in more than one county may choose, at the time of the formation of the committee, and based upon watershed boundaries, to participate in the stormwater management planning program of either or both of the counties.
(B) The Committee shall include the community within the scope of its planning and enforcement jurisdiction unless the community provides evidence of its participation or intent to participate in the stormwater management-planning program of another county.
