§ 133.05 ENFORCEMENT OF FIREWORKS.
   (A)   Public nuisance. It is hereby declared that the possession, explosion, firing, igniting, use or discharge of any display fireworks, flame effects and consumer fireworks without a permit from Will County is a public nuisance.
   (B)   Intent. The purpose of this section is to give authority to the Will County Sheriffs Department to enforce restrictions on fireworks within the limits of unincorporated Will County. This section shall be enforced by the Will County Sheriffs Department. This section shall not apply to the pubic exhibition or sale of fireworks previously approved by the Will County.
   (C)   Fireworks and pyrotechnics violation. It shall be a violation of this section to possess, explode, fire, ignite, use or discharge any display fireworks, flame effects and consumer fireworks within unincorporated Will County. For purposes of this section, display fireworks, flame effects and consumer fireworks shall be as defined in ILCS Ch. 425 Act 35 et seq., Definitions.
   (D)   Confiscation of fireworks. The Will County Sheriffs Department shall have the authority to immediately confiscate any display, fireworks, flame effects, and consumer fireworks in violate of this section and to promptly and safely destroy said items.
