§ 112.99 PENALTY.
   Each separate violation of this chapter may be considered as a civil offense or a criminal offense:
   (A)   Civil penalties.
      (1)   (a)   The specific civil fine that may be imposed for each separate offense and violation of this chapter is hereby established as one hundred dollars ($100.00) minimum and five hundred dollars ($500.00) maximum for each separate offense.
         (b)   The city’s Code Enforcement Officer, shall enforce this chapter and its penalty provisions.
         (c)   Multiple violations (three (3) or more) of this chapter may result in occupational license suspension as decided by the Code Enforcement Officer;
         (d)   The city’s Code Enforcement Officer may, in lieu of immediately issuing a civil citation therefor, give notice that the violation of this chapter shall be remedied within a specific period of time.
      (2)   Civil appeals. Any decision of the city’s Code Enforcement Officer may be appealed to the City Council by filing a written notice to the city’s Code Enforcement Officer and request for an appeal hearing within ten (10) days of the issuance of a civil fine by a Code Enforcement Officer. Said hearing before the City Council shall occur within thirty (30) days of the receipt of the written request for an appeal hearing.
   (B)   Criminal penalties. Each violation of this chapter may be considered to be a Class B misdemeanor for which everyone convicted thereof in a court of competent jurisdiction shall be sentenced to pay a criminal fme not to exceed the maximum of two hundred fifty dollars ($250.00) and a term of imprisonment not to exceed the maximum period of ninety (90) days in jail or both.
